These Terms govern your access to the KickDemo interactive demo workspace, Chrome capture extension, Route Hubs engine, and Motion Studio.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "you") and KickDemo ("KickDemo," "we," "us," or "our"), regarding your access to and use of our web application, browser recording extension, Route Hubs engine, Motion Studio, and related services (collectively, the "Service").
By creating an account, installing the browser extension, or accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of an organization, you represent that you possess the requisite authority to bind that entity.
When registering, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your credentials and for all activities occurring within your workspace. You must notify us immediately at hello@kickdemo.com upon discovering any unauthorized access or breach of security.
Subject to compliance with these Terms, KickDemo grants you a non-exclusive, non-transferable, revocable, worldwide license to access the platform and deploy our Chrome capture extension to create, edit, host, and embed interactive walkthroughs and Route Hub funnels for your commercial business purposes.
As between the parties, you retain all rights, title, and interest in and to all data, media, text, graphics, and video assets uploaded or captured through the Service ("Customer Content"). You grant KickDemo a limited license to host, display, and process your Customer Content solely to provide and operate the Service on your behalf.
KickDemo retains all rights, title, and interest in and to the platform codebase, visual UI components, Motion Studio rendering pipeline, algorithms, and documentation.
You agree not to use the Service to:
Subscription Plans: Paid tiers (e.g., Starter, Pro, Enterprise) are billed on a recurring monthly or annual basis as specified during checkout. Subscriptions automatically renew unless cancelled prior to the renewal date.
Payment Processing: All transactions are securely processed by PCI-compliant payment gateways. You agree to provide current, complete billing details and authorize applicable charges.
Refunds: We provide a 14-day satisfaction refund window for initial paid subscriptions. After 14 days, fees are non-refundable except where mandated by applicable consumer protection laws.
KickDemo maintains a 99.9% uptime commitment for public walkthrough delivery and player embeds. Scheduled maintenance windows with potential brief downtime are announced in advance and conducted during off-peak hours.
The Service may support integrations with third-party CRM systems, analytics providers, or cloud services. KickDemo does not control and is not liable for third-party tools or their operational uptime.
You may cancel your subscription at any time via your workspace billing portal. Cancellation takes effect at the conclusion of your current prepaid billing cycle. Upon account termination, your published walkthrough embeds will become inactive, and your workspace assets will be permanently deleted after 30 days.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL KICKDEMO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO KICKDEMO DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless KickDemo and its officers from and against any third-party claims, damages, liabilities, and expenses arising out of your Customer Content, your breach of these Terms, or your violation of applicable laws.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any legal action or dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming.
